1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.
2. Entries open 18/01/2012 and remain open until 11:59pm AEDST on 17/02/2012 ("Promotional Period").
3. The Contours 6 Week Challenge will run from 18/02/2012 – 30/03/2012. (“Challenge Period”).
4. Entry is only open to Australian residents who have paid the 6 Week Challenge fees at their Contours studio of choice by 18/02/2011. ("Eligible Challengers").
5. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter as Eligible Challengers.
6. To enter, Eligible Challengers must, during the Promotional Period, visit their Contours studio of choice and complete an health assessment including a BioAge health assessment, weigh in and measurement of arms, bust, waist, hips and thighs. This will then determine the “Starting BioAge”, “Starting Weight” and ”Starting Measurements”.
7. It is then a requirement that the participating Contours studios upload each Eligible Challenger’s details into the studio section of the Contours 6 Week Challenge website by 11:59pm AEDST on 17/02/2012. These details must include the Eligible Challenger’s Starting BioAge, Starting Weight, Starting Measurements.
8. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Challengers (including an Eligible Challenger’s identity, age, contact details and place of residence) and to disqualify any Eligible Challenger who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process, or whom uses performance enhancements in any way (including but not limited to lap band surgery and stomach stapling). Errors and omissions will be accepted at the Promoter's sole discretion.
9. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
10. Only one entry is permitted per Eligible Challenger.
11. There will be three (3) national winners.
12. This is a game of skill and chance plays no part in determining the winners. At the conclusion of the Challenge Period each Eligible Challenger must complete a second health assessment including a BioAge health assessment, weigh in and measurement of arms, bust, waist, hips and thighs.. This will then determine the “End BioAge”, “End Weight” and “End Measurements”.
13. It is then a requirement that the participating Contours studios upload each Eligible Challenger’s details into the studio section of the Contours 6 Week Challenge website by 11:59pm AEST Wednesday 04/04/2012. These details must include the Eligible Challenger’s Starting BioAge, Starting Weight, Starting Measurements. The Promoter and each Contours studio are not responsible for any failure to upload the Eligible Challenger’s details or for any errors or omissions in the details uploaded.
14. A computer program has been established and tested to make the necessary calculations to determine the winners. The Promoter and each Contours studio are not responsible for any failure, error or omission of the computer program.
15. There will be three winners for the Promotion: one Weight Loss Winner, one BioAge winner and Biggest Fundraiser prize winner. The three winners will be determined by the following formulas:
Weight Loss Winner
Round 1 - Biggest weight lost percentage, 3 decimal place. (Total weight lost divided by start weight then multiplied by 100). If there are multiple challengers with the same weight loss percentage, those challengers will then move to stage 2.
Round 2 - Biggest centimetre loss percentage, 2 decimal place. Total centimetres lost divided by total starting measurements (arms + bust + waist + hips + thighs) multiplied by 100.
BioAge Winner
Round 1 - The winners will be the individuals with three largest differences between Starting BioAge and End BioAge (Starting BioAge minus Ending BioAge);
Round 2 - the winners will be the individual(s) with the three largest difference of their End BioAge and their actual chronological age in whole years calculated (End BioAge minus Chronological Age); and
Round 3 - the winners will be the Eligible Challengers with the greatest percentage weight loss during the Challenge Period will be deemed the winners (Total weight lost divided by start weight then multiplied by 100).
Biggest Fundraiser
Calculated automatically by the Everyday Hero Platform. Awarded to the Challenger who raises the most funds for The McGrath Foundation through the Everyday Hero platform.
If following Round 1, there is more than one Eligible Challenger with the same result (as applicable) then Round 2 will be applied to those Eligible Challengers with the same result to determine the relevant prize winners. For the BioAge winner if following Round 2, there is more than one Eligible Challenger with the same result for the first, second or third largest difference (as applicable) then Round 3 will be applied to those Eligible Challengers to determine the relevant prize winners. If there remain multiple Eligible Challengers with the same result from Round 3, it will be left to the discretion of the Promoter to determine the relevant prize winners, in its sole discretion.
16. Winners will be announced on Wednesday, 11/04/2012. The Weight Loss winner will receive the Ultimate Girls Weekend. A weekend in Sydney for two (2). This prize will include; Return airfares from the winners capital city to Sydney airport, Transfers to and from Sydney Airport, 5 Nights 5 Star accommodation, The Style Mother & Daughter, Partner or BFF Makeover Package, a combined 3 hour personal shop with an elite Personal Fashion Stylist + Styled Hair cut & Blow Dry for both from one of The Style Agency's professional Hair Partners + Make Up Application and a minimum $60.00 worth of free product for both winner and friend; Dinner for two worth $250, 2 x Gold Class Event Cinema Movie Tickets and $1000 spending money. 17. All winners of prizes will be notified by telephone and email. The Promoter's decision is final and no correspondence will be entered into.
18. The Promoter reserves the right, at any time, to award additional prizes to Winners, but is under no obligation to in this regard. Prizes will be determined by the Promoter in its absolute discretion. Prizes may be subject to additional conditions upon their use which will appear in these Terms and Conditions and winners agree to abide by the conditions. If any winner refuses to accept these additional conditions the Promoter may, in its absolute discretion, refuse to award the prize to the winner.
19. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
20. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.
21. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
22. Eligible Challengers consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, text, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products and/or services manufactured, distributed and/or supplied by the Promoter or its associates including all Contours studios.
23. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Challenger; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
24. Any cost associated with accessing the promotional website is the Eligible Challenger’s responsibility and is dependent on the Internet service provider used.
25. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Eligible Challenger; (f) use of a prize; or (g) if the Contours 6 Week Challenge event is cancelled for any reason beyond the reasonable control of the Promoter.
26. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, and prize suppliers. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless and until at anytime the participant in this promotion requests otherwise, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages, direct mail or telephoning an Eligible Challenger. Eligible Challengers should direct any request to access, update, delete or correct information to the Promoter. All entries become the property of the Promoter.
